Woman Receives $9.9 Million Jury Award In Costco Shopping Cart Injury Case

A Brooklyn federal jury awarded an ex-photographer and multimedia artist over $9.9 million for permanent damage she sustained from a shopping cart injury at Costco.

A Brooklyn federal jury awarded an ex-photographer and multimedia artist over $9.9 million for permanent damage she sustained from a shopping cart injury at Costco.
The injury occurred in 2009 at Costco’s Brooklyn location, according to court papers (Docket #10 CV 00374). The victim, 52-year-old Rose Nudelman, was riding up an escalator with her new husband and loaded shopping cart.
Because the ascending escalators at Costco’s Brooklyn location have locking mechanisms designed to secure & transport shopping carts between floors. However, as Nudelman waited to reach the next level, the shopping cart somehow dislodged and fell back into her wrist, according to court testimony.
“Suddenly, something caught my attention and when I looked towards the shopping cart, I saw that it was coming towards me quickly,” Nudelman said. “The shopping cart struck me in force.”
Nudelman’s attorney, Michael Ronemus of Ronemus & Vilensky, LLP., said Nudelman filed a report with Costco and left the store. She did not initially notice signs of major injury, but soon started suffering from a rare neurological condition called complex regional pain syndrome.
Court papers state that the syndrome was so debilitating that it took away her mobility and forced her to use a cane. According to court statements, the condition also forced her to abandon her passion and profession as a multimedia artist. Based on this and Ronemus’s efforts in court, jurors awarded Nudelman $9,903,825 to cover her medical costs, pain and suffering.
“There is no one you or I know who would change places with Ms. Nudelman for any amount of money,” Ronemus said.
