Remote Signing Protocol

  • Video Conferencing Capability: They utilize video conferencing capability (VC) that is easily accessible by their clients. In light of the fact that some clients may not have video cameras on their computers, the VC should be usable by the client on their cell phone.

  • Document Scanning and Transmission: Clients may need to have access to a reliable document scanning capability to upload documents (via mobile phone) and transmit them to the lawyer. Lawyers should also ensure that documents can be couriered to clients if necessary.

  • Virtual Closing Procedure: A video conference is scheduled 48 hrs before the closing, to allow the client for time to courier documents if necessary. The client has to send the scanned copies of identification to the lawyer for review before the scheduled video conference. Lawyer reviews documents with the client during the video conference and witnesses/commissions wet signature of documents by the client. Lawyer affixes wet signature to applicable scanned and/or original copies of documents from the client to complete the witnessing/commissioning function.

Managing the Risk of Virtual Commissioning:

There is always a possibility of risk involved during the virtual commissioning. So, the lawyer or paralegal would be alert to the risks of doing so, which may include the following issues:

  • Fraud

  • Identity theft

  • Undue influence

  • Duress

  • Client left without copies of the documents executed remotely

  • Clients feel that they did not have an adequate opportunity to ask questions or request clarifying information about the documents they are executing.

The firm is constantly working to determine and execute steps to assist clients to curb the risks mentioned above during the virtual commissioning. We are helping clients to get extensions from the sellers and builders, if the clients have lost jobs or in financial situations during this time. This is avoiding buyers to be in breach of agreement of purchase and sale and avoiding litigation.”

They follow this protocol to serve their clientele on several legal matters such as real estate closing, refinance, private mortgages, or weather that may be business law, review of agreements, incorporation, and dealing with minutes books. They also continue to provide notary services with prior appointments as well. For this, they use a similar protocol like banks of getting the client orally declare on the phone and in-person that they do not have any symptoms of virus, or have been in contact with someone who did and that they have not traveled. Any client coming into the office is requested to wear a mask and gloves, and bring their own pen.
