In one Los Angeles real estate transaction where hillside subsidence issues were concealed from the buyer, Timothy Norton successfully pursued a claim for rescission and damages in arbitration, when extensive landslide engineering would have been required to remedy the problem (which was known by the seller and concealed from the buyer) and successfully reversed the transaction, and restored the entire purchase price, plus interest and costs to the buyer-client. Using a team of experts, including an expert in real property disclosures and seller standard of care, a geotechnical expert, cost estimators and appraisers, Timothy Norton won the case for the client, and successfully rescinded the sale transaction, with damages, costs, interest and attorney fees awarded.

Timothy Norton has successfully represented a client who purchased a brand-new hillside, glass and steel custom modern design home, who soon after the close of escrow discovered extensive leaks in the roof, roof-decks, walls, windows, doors, pool and planters. A thorough investigation revealed defects in the electrical system, air-conditioning and in the workmanship and building materials. The result was a successful settlement and recovery of the entire cost of repair, and an additional recovery of damages against the prior attorney who failed to include claims against the Lender, which had been directly involved in the construction, construction financing, hiring and appointment of the general contractor and various subcontractors, as well as having been directly involved in the sale disclosures and sale transaction documents. The totality of the recovery was in fact in excess of the cost of repair, a truly exceptional result.  This involved a combination of cost of repair analysis, real estate appraisal and values, a forensic analysis of the construction and lending records, as well as the intricacies of a claim against the prior attorneys. This required a series of timed mediations in coordination with trial preparation and an impending trial date.

Timothy Norton has successfully litigated and negotiated the status of construction and purchase financing loans with Lenders and gained settlements that completely exonerate the borrowers and millions of dollars in outstanding personal and corporate loan guarantees. In one instance, this involved gaining settlements and offsets worth twice the properties’ value, the removal of onerous personal and entity debts and mechanics liens, in addition to a cash recovery to the client. This also involved the coordination of multiple complex cases and multiple parties and insurance coverages, and the use of multiple mediation sessions and court mandatory settlement conferences on multiple tracks while simultaneously preparing the case for a potential 6-9 month trial.

In another instance, Timothy Norton secured a settlement after just a few weeks of involvement on behalf of an investor who had lost over $1million a project in Hawaii that had been manipulated by an internationally based contractor. The engagement involved a review of the prior attorneys involvement and extensive negotiations with the contractors attorneys and representatives, and extensive discussions with the client to understand the issues and potential claims, and a specifically detailed negotiation strategy that ultimately resulted in a complete acceptance of the client’s proposed settlement, with an immediate payout and an end to the dispute. In another instance, for the same client, Timothy Norton successfully litigated and ultimately negotiated a settlement with the sellers of commercial property on claims of non-disclosure and concealment of material facts relating to the use of the property, and commingled parking areas, resulting in a settlement with all parties and a complete resolution of the dispute.

Timothy Norton has successfully represented clients in disputes with Homeowners Associations, and in one instance, prevailed against the HOA and recovered 100% of the costs and fees incurred.

Timothy Norton has been involved in the representation of a major Japanese conglomerate which working for a prestigious New York law firm on a construction defect and real estate matter that ultimately went to trial, was tried before a jury over the course of 13 months, resulting in a resounding victory for the client in the total sum of $180m, with $70m in punitive damages, an award that was paid in full.
