Now more than ever, consumers and small business need a plain and simple understanding of laws and contracts.

As fear and lockdowns hurt consumers and small business, a group of New York and New Jersey lawyers are launching a website to help the public better understand the law and their contract rights called plainlanguage.biz. Our group of lawyers are making it their business, to put things into plain language, says Alex Fotopoulos, an attorney in New York and New Jersey.
It seems that with so much confusion surrounding state lockdowns and new executive orders, many consumers and small businesses need plain and simple help understanding their rights in these unprecedented times, added Fotopoulos. Contracts are agreements, and should not be straitjackets – if there are breaches, there are consequences but there should also be negotiation and empathy. And most importantly, clarity.
The impetus for the plainlanguage.biz website is the growing concern that too many laws and contracts contain confusing and potentially invalid provisions that may violate the rights of consumers and small business.
New Jersey in particular has a law, the Plain Language Act, that requires that contracts be written in a simple, clear, understandable and easily readable way. And ironically, they also have a law that despite a confusing name – the Truth-In-Consumer-Warranty Act, Truth-in-Consumer Contract, Warranty, and Notice Act (referenced as the “TCCWNA”) provides consumers and small businesses remedies where a contract, warranty, notice or sign contains a provision which attempts to deceive or confuse someone to relinquish their rights. The public is either unaware of laws like these or in the current state of confusion and panic, has forgotten.
Plainlanguage.biz supports the use of clear communication in contracts, legal documents and laws; and will serve to remind the public of their rights under the law. Plain language saves time, saves money, and is good customer service and makes life easier for the public.
Plain language means the public understands the laws and the world they operate in at all times. The public deserves plain language and in many cases, the law demands plain and unconfusing language.
