The Law Offices of Dr. Bruce G. Fagel & Associates has achieved a $59.3 million verdict for a child who was a victim of birth-related medical malpractice. The girl, 3, now suffers from cerebral palsy due to experiencing asphyxia during her birth process

According to Dr. Fagel of the Law Offices of Dr. Bruce G. Fagel & Associates, the malpractice occurred when nurses noticed that the blood pressure of the child’s mother remained elevated 6.5 hours after the woman was placed in the hospital to undergo labor induction. At that time, the nurses decided against calling the obstetrician. However, the obstetrician assessed the woman’s condition four hours later and issued a diagnosis of pregnancy-induced hypertension, or PIH, which made her high risk.
Later that afternoon, a nurse noticed that the woman’s fetal monitoring strip was displaying negative changes, so she increased the quantity of Pitocin that the mother was receiving to induce labor in her. Later, another nurse tried to deliver her child vaginally but struggled to do so and thus ordered a Cesarean section. The child was eventually delivered but had severe neonatal asphyxia.
Dr. Fagel was able to prove that the obstetrician and nursing staff were negligent when they increased the Pitocin amount despite noticing distressing readings on the fetal monitoring strip. According to Dr. Fagel, the combination of the Pitocin increase and the woman’s PIH triggered her baby’s acute asphyxia.
The staff should have also begun the Cesarean section sooner, as this would have resulted in a healthy infant, according to Dr. Fagel. Dr. Fagel furthermore demonstrated at trial that one of the nurses involved in the mother’s care was inexperienced and thus struggled to properly interpret her fetal monitoring strip.
According to the Law Offices of Dr. Bruce G. Fagel & Associates, about $49 million of the verdict was awarded to cover future and past medical costs; $400,000 was allotted to the child’s parents for their emotional distress; and nearly $10 million was slated to cover the child’s future lost earning capacity.
