From August 17 to November 1, 2017, the Multistate Tax Commission (“MTC”), in conjunction with 25 member states, offered a 10-week sales tax amnesty program aimed at helping online sellers to become compliant with sales tax nexus regulations.
After Richard Cram, MTC Program Director, presented in March 2017 at PROSPER Show’s internet business exhibition, he and PROSPER president James Thomson discussed how to put together a sales tax amnesty program to help online sellers address potential sales tax liability. Mr. Cram secured the cooperation of 25 of his member states (including District of Columbia), and the MTC rolled out the sales tax amnesty program for online sellers in August. For most of the participating states, online sellers were able to apply to have all unpaid sales taxes waived without penalty, as long as the sellers registered and started paying sales tax going forward.
PROSPER Show president James Thomson noted that while 850 sellers may be a small proportion of the hundreds of thousands using FBA today for their Amazon businesses, these sellers all had to be large enough to meet the participating states’ minimum tax threshold levels needed to participate. He added “we are very grateful for this opportunity MTC has provided large Amazon sellers, and look forward to continued education around sales tax responsibility of Amazon sellers”.
The Multistate Tax Commission is an intergovernmental state tax agency working on behalf of states and taxpayers to facilitate the equitable and efficient administration of state tax laws that apply to multistate and multinational enterprises. The MTC also handles voluntary tax disclosures, by which sellers that did not participate in this sales tax amnesty still have the ability to file with states, allowing the sellers to reduce the period of back taxes that they may owe.
