Mandatory Notices Needed - Free Employer-Friendly Notice Updated

It’s 2014 – have you noticed your employees about Obamacare?

Employers must now provide new employees with mandatory notices about health insurance options and the availability of the state and federal Health Insurance Exchanges, and the website Obamacarenotices.com has been updated to help employers meet this new requirement.

How Do You Know If Your Company Must Provide the Notice?
All employers who are subject to the Fair Labor Standards Act (FLSA) must provide the notice. Many employers fall under the FSLA because they have $500,000 or more of annual sales or receipts. There is more information about the FSLA on the website at Obamacarenotices.com.

The Government Provides a ‘Sample Notice,’ Why Shouldn’t I Use It?
The ‘Model Notices’ suggested by healthcare.gov demands more information than the law actually requires. The notice at Obamacarenotices.com has been prepared by ERISA attorneys to provide the information that is required, and no more than what is required.

What About Providing the Notice in Spanish or Some Other Language?
Employers who currently provide Spanish or other language translations to their employees should also provide the notice in that language. The notice at Obamacarenotices.com is also offered in Spanish.

What Happens if I Fail to Notify Employees?
An employer could be assessed a penalty of $100 for each day that the notice is delinquent.

DOL Technical Release 2013-02, which discusses the information required in a compliant notice:

“Pursuant to the statute, the notice to inform employees of coverage options must include information regarding the existence of a new Marketplace as well as contact information and description of the services provided by a Marketplace. The notice must also inform the employee that the employee may be eligible for a premium tax credit under section 36B of the Code if the employee purchases a qualified health plan through the Marketplace; and a statement informing the employee that if the employee purchases a qualified health plan through the Marketplace, the employee may lose the employer contribution (if any) to any health benefits plan offered by the employer and that all or a portion of such contribution may be excludable from income for Federal income tax purposes.
