After 22 grueling years, New York personal injury attorney, Mitchel H. Ashley of the Ashley Law Firm PLLC, won a major environmental case, better known as the Pelham Bay Landfill Case. Mr. Ashley fought diligently to prove the toxic wastes that were illegally dumped in the closed Pelham Bay landfill in 1979, caused contaminates to seep into the air, soil and water supply. As a result, some residents who lived near the landfill developed cancer.
The Pelham Bay Case, also referred to as ‘Nonnon vs. The City of New York’ began deliberation back in 1991 when Bronx resident, Patricia Nonnon’s daughter passed away from leukemia, due to exposure to the contaminants. In 1992, Mr. Ashley, a 25-year-old at the time and a Hofstra Law School graduate, worked on the Pelham Bay Case through a summer job at Glaser, Shandel and Blitz.
During the past two decades, this case was bounced around from the state Supreme Court to its Appellate Division. Expert witnesses fought a good fight to prove (or disprove) that the toxic waste dumped in the landfill caused a cancer cluster in the area.
Finally, on July 29, 2013, at the Bronx Supreme Court building, a verdict was reached and the plaintiff won a settlement of $12 million. Mr. Ashley was not only speechless because the case was won, but the case finally came to a close.
“It is surreal. After working long and hard on a case for 22 years, it becomes a part of your life,” says Mr. Ashley.
Although Mr. Ashley is relieved that the case has finally come to an end, there is not a day that goes by that he doesn’t think about the case.
“It feels good that the victims’ families can finally move on with their lives. However, no amount of money can compensate them for the loss of their loved ones.”
